Liability Insurance

The written law regarding liability coverage for acts of volunteers is again not clear.  However, the common law that has evolved is that agencies do not allow its volunteers to suffer personal liability for injuries to others which occur during the course of the services they perform.  Additionally, Government Code Section 810.2 defines an employee for purposes of claims and actions to include "...an employee, or servant, whether or not compensated..."  Thus, under normal circumstances the CSU would protect volunteers from personal liability, the final decision may relate to specific factual circumstances.
